Welcome to Christmas Warehouse! We're here to make Christmas shopping as easy, enjoyable and merry as possible. These Terms & Conditions explain how we sell our products, how our website and services work, and the rights and responsibilities that apply when you shop with us.

Please take a moment to read these Terms & Conditions before making a purchase or using our website. They form part of the agreement between you and Christmas Warehouse when you purchase products from us, whether you shop online, in one of our stores, or through another sales channel we make available.

By placing an order with us, purchasing a product, or using our website and services, you agree to be bound by these Terms & Conditions, together with any additional terms that apply to a particular product, promotion, service or purchase.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies you may have under the Australian Consumer Law or any other applicable law. Where your legal rights provide you with greater protection than these Terms & Conditions, those rights will continue to apply.

Shopping With Christmas Warehouse

We want every part of your Christmas shopping experience to be as straightforward and enjoyable as possible. These Terms & Conditions are written in plain English wherever possible, so you can easily understand what to expect from us and what we ask of you.

We are committed to treating our customers fairly and respecting your rights.

Our products come with consumer guarantees under the Australian Consumer Law. These guarantees cannot be excluded, restricted or replaced by our Terms & Conditions. Depending on the circumstances, you may be entitled to a replacement or a refund, where a product does not meet the applicable consumer guarantees.

Our policies may provide additional rights or benefits beyond your legal rights, but they do not take away or reduce any rights you have under Australian law.

Christmas, like our Terms & Conditions, can change from time to time. We may update these Terms & Conditions to reflect changes to our business, products, services, technology, promotions or applicable laws.

When we make changes, the updated version will be published on our website with a revised effective date. The Terms & Conditions that apply to your purchase will generally be the version in effect when you place your order, unless a change is required by law or otherwise applies to an existing arrangement.

Christmas Warehouse VIP Club

VIP Club Membership

  • VIP club membership is issued by Globeworks Pty Ltd. trading as The Christmas Warehouse (ABN 56 114 321 327).
  • VIP club membership is conditional on you making at least 1 purchase every 3 years. If membership is cancelled due to inactivity, all member benefits, including accrued points and achieved discount levels, will cease. To reclaim these benefits, members will need to rejoin the club.
  • By joining the Christmas Warehouse VIP Club you agree to join the Christmas Warehouse marketing program and receive ongoing mail and electronic mail from the Christmas Warehouse and its associated entities. This may include newsletters, catalogues, special promotions, email messages, sms messages etc. 
  • You have the option to unsubscribe from The Christmas Warehouse Marketing program. When you unsubscribe, membership to the Christmas Warehouse VIP Club will be terminated and all member benefits, including accrued points and achieved discount levels, will cease. To reclaim these benefits, you will need to rejoin the club. 
  • All VIP club member discounts must be claimed at the time of purchase whether in-store or online. No discounts will be back dated. 
  • Points accrue at the finalisation of a transaction. Points earned in a transaction are not applied to your points balance until a transaction is complete. Please allow up to 60 minutes for points to move between an on-line and an in-store purchase.
  • Transactions that result in your points balance enabling a higher discount rate will be discounted at the discount rate indicated by your points balance at the beginning of the transaction. 
  • VIP Club discount cannot be used in conjunction with other special offers. 
  • All in store discounts are subject to stock availability. No rain checks will apply. 
  • Benefits associated with The Christmas Warehouse VIP Card, including points, are not redeemable for cash. 
  • The Christmas Warehouse may also substitute benefits for equivalent value. 
  • The Christmas Warehouse shall not be liable in any way if member benefits are unavailable for any reason. 
  • The Christmas Warehouse is not responsible if your details are incorrect, outdated, or unavailable online or in-store. It is your responsibility to maintain your membership online, by telephoning the Christmas Warehouse, or by emailing customerservice@christmaswarehouse.com.au
  • All special offers made by affiliated partners of the Christmas Warehouse to VIP Club members are made directly by such affiliated partners to VIP Club members independent of The Christmas Warehouse and can be withdrawn or changed by the affiliated partner without notice. 
  • Christmas Warehouse employees and related family members are eligible to join the VIP Club. Certain member benefits and eligibility to competitions may however be restricted. 
  • By joining The Christmas Warehouse VIP Club you agree to be bound by these terms and conditions. 
  • These terms and conditions as well as VIP member benefits may change from time to time and are subject to change by the Christmas Warehouse at its absolute discretion without prior notice. The Christmas Warehouse is not liable to any card holder for any injury, loss or damage in these circumstances.

  • These terms and conditions are binding on all members of the VIP Club regardless of the date on which the member joins or the manner in which they join the VIP Club. 
  • VIP Club membership may be terminated or suspended by the Christmas Warehouse at its absolute discretion at any time and without notice or giving reasons for its decision. 
  • The Christmas Warehouse is not liable in any way whatsoever for any injury or loss (including any indirect or consequential loss) of any kind to person or property suffered by any VIP member whether by reason of any act or omission, deliberate or negligent, of the Christmas Warehouse in connection with the VIP Club, including injury or loss incurred whilst participating in any activity of the VIP Club or the Christmas Warehouse or in any activity in which cardholders are invited to participate. This condition is subject to any liability which may not be lawfully excluded, in which case such liability will be limited to the fullest extent permitted by law. 
  • Member benefits are not transferable.

Earn points immediately! Each dollar you spend on items in store or online accrue 1 full point.

  • Join for free and accrue from your first purchase.
  • Accrue points to increase your discount level.

  • Junior Elf 0 to 299 points 3% discount
    Senior Elf 300 to 999 points 5% discount
    Master Elf 1000 points or more      10% discount*

  • You must make at least 1 purchase every 3 years to maintain your points. 
  • Points do not diminish when making a purchase 
  • Accrued discount level is available to view by logging in to your online account. 
  • Points accrue for purchases online and in store. Discount benefits are available online and in store. 
  • Please allow up to 10 minutes for your details to be available in store once you have signed up. Unplanned and unforeseen circumstances may prevent data from being available in store within that time. In that case, you MUST be able to show your membership online, including points, in order to claim your discount. 
  • Points are not redeemable for cash or any other benefit.
  • You can join the VIP Club online only at www.christmaswarehouse.com.au
  • As a VIP member, you are eligible to accrue points and enjoy the discounts at any store in Australia, and online. 
  • Freight charges online do not accrue points, and are not subject to discounts. 
  • Your discount is calculated as a reduction off the selling price of the goods in store at the time of purchase. 
  • Points for a transaction accrue at the finalisation of a transaction, Transactions that result in your points balance enabling a higher discount rate will be discounted at the discount rate indicated by your points balance at the beginning of the transaction. 
  • If you were a VIP member BEFORE AUGUST 2015, you have an automatic opening balance of 1500 points and maintain your 10% discount. A purchase is required every three years from July 2014 to maintain your membership, points, and discount structure.
  • This discount cannot be used in conjunction with any other offer. You must claim (ask for) your discount at the time of purchase by indicating that you are a VIP member. Member details must be present online or in-store for benefits to apply. No discounts will be back dated. Staff of The Christmas Warehouse are not obligated to ask if you are a VIP Club member. 
  • To claim your VIP discount, you can either present your Christmas Warehouse VIP Club card, state that you are a member, or provide a member number to checkout staff . If staff are unable to locate your membership, they are not authorised to provide a discount.
  • You can show your VIP card at checkout on your smartphone screen by logging into your account on our website. 
  • You may use any form of photo ID to confirm your VIP membership. On occasion, staff may request that you show proof of your ID.

Competitions

Shopping Voucher Competitions

From time to time, we run VIP Shopping Voucher competitions with a shopping voucher as the prize. In addition to the dates stipulated on the competition prize page and in the prize description, the following terms and conditions apply to all such competition prizes:

 
  • Entry to the Competition is available to new and existing members of the Christmas Warehouse VIP club.
  • VIP Shopping Voucher prizes are valid for in-store purchases only, unless expressly stated otherwise on the competition page. The vouchers are not available for online purchases.
  • Vouchers are not transferable and so are redeemable by the winner only. The winner will be asked for photo ID, and the voucher code at the register to verify the prize.
  • Vouchers cannot be redeemed for cash or store credit notes. 
  • Vouchers can only be redeemed for items that are in stock and available in the store in which the voucher is presented at the time the voucher is presented.
  • The voucher amount can be used against the purchase of items in store at the store price ticket price. Prices in the register take automatic precedence over any ticketed price in the case of ticket error.
  • The full amount of the voucher is to be used at one time – change cannot be given in any form.
  • The VIP discount is not applied to items being purchased using a Shopping Voucher prize. The register price will be charged with no additional VIP discount.
  • Vouchers must be fully redeemed by the expiry date. If not redeemed by this date, the voucher will expire.
  • Vouchers cannot be used in conjunction with any other special offer that may apply at the time.

Sales terms when you purchase goods from us

Pricing

We will at all times use our best endeavours to ensure that the prices on our website are accurate at any point in time. The prices that are displayed on our website and in our company at any point in time are only current at that particular point in time and we reserve the right to alter our prices at anytime without any notice being provided to you. This may occur for example when products are on sale or when prices may change for various reasons. When price changes do occur, they will be automatically updated on the website.

At all times however, we can assure you it is our sincere intention to offer you the lowest price in Australia for the same product. The prices indicated for products include GST and exclude freight and handling. 

Goods And Services Tax

Goods and services tax is applicable on all our products. As you will note from our site, in our Megastores and in our catalogues, all prices include GST. The current rate of GST is 10%. This rate may change in the future and will be based on Australian legislation.

Authority To Purchase

 
By accepting our sales terms and conditions, you are acknowledging that you have the authority to enter into a commercial transaction with the Christmas Warehouse. If you are under 18 years of age, you cannot enter into a transaction with The Christmas Warehouse. Instead, you should seek the assistance of your parents or guardians. Commercial employees, purchasing on behalf of their company or business must have the appropriate company authority to enter into a transaction on the company's behalf.

Availability Of Product

All products on are website are supplied subject to availability. We will use our best endeavours to supply you with the product you have ordered from us. On occasion however, goods that are displayed on our website and purchased by you may not be available. In most cases, this is as a result of timing differences between the time you finalise your order and the dispatch of the order from our warehouse. This may also be as a result of the short supply or unavailability of the product you have ordered being available from our suppliers. If this occurs, we will contact you and offer you a part dispatch for the balance of your order that is available or issue you with a refund or credit note for that part of the order that cannot be supplied. (See refunds and credit notes).

Title

Title for goods ordered on our site will pass to you when we receive payment in full for your order.

Password Security

When shopping with The Christmas Warehouse, or when you join our VIP Club, you will be asked to provide a password. You are responsible for this password and you should prevent the password from being disclosed to any third party.

Passwords help protect your personal information and you should carefully consider your chosen password.

Here are a few general tips to help you strengthen the security of your passwords:

  • Don't use conventional words
  • Avoid regular words with numbers added to the end
  • Avoid using regular words that are simply written backwards (e.g. your name)
  • Don't use personal information in your passwords like your name and date of birth
  • Don't use your phone number
  • Use a combination of letters, numbers and symbols
  • Try include a word in your passwords that has personal meaning as it will be easier to remember
  • Change your passwords on a regular basis
  • Try and use different passwords for different applications
Delivery Procedure

After you have purchased your desired goods from us, our warehouse will consolidate and pack your order in industrial strength packaging ready for delivery to you.

Your order is delivered to you by an independent courier company. We have conducted business with these companies over many years as have many companies throughout Australia, and we are confident that this method of delivery of your order is the most safe, efficient and economical method of transporting your goods to you. The courier companies that we use pride themselves on a very high level of service and performance.

Your order will have a consignment note accompanying it when it is delivered to you and the delivery driver will ask you to sign this consignment note when the goods are delivered to you. It is essential that you carefully read the consignment note. Only sign the consignment note if the cartons of the goods delivered have not been damaged in any way and only if the total quantity of the cartons on the consignment note have been delivered. If any of these instances occur you must write down the problems on the consignment note (e.g. 4 cartons on the consignment note - but only 2 cartons delivered) and request the delivery driver acknowledge this by printing his/her name on the consignment note. In addition, please e-mail us as soon as possible advising us of the details. If you do not follow this procedure and sign the consignment note without making these notes, you are acknowledging that the entire delivery is correct and in perfect condition.

We highly recommend that you choose a delivery address where during the main course of the day, someone is present to accept your delivery. Your workplace is the ideal delivery point. The courier companies cannot guarantee a delivery date or time due to the volume of their deliveries however the majority of deliveries are between 9:00am and 5:00pm.

If no one is present to accept the delivery, the delivery driver will leave a delivery card in your mail box or under you door, noting that they have attempted to deliver the goods to you. This delivery card will have all the contact details for the delivery company and you will need to contact the delivery company to arrange a suitable time for a second delivery to you within 48 hours. 

 

International orders

All international orders are currently sent by Australia Post and delivered by your local post company.

Incorrect Goods


We will use our best endeavours to supply you with the product you have ordered from us. On occasion however, we may accidentally supply you with an incorrect product that you have not ordered. If this occurs, we will supply you with the correct product ordered by you once the incorrect product has been returned to us in accordance with the returns guidelines set out below. If the product you have ordered is no longer available, please refer to the section refunds and credit notes (see below).

Damaged In Transit

All orders that you place with us on our website will be delivered to you by independent courier companies.

These couriers will use their best endeavours to supply you with the product you have ordered from us in the condition that the goods were dispatched from our warehouse. On occasion however, goods are damaged in transit to you.

If this occurs, you will need to contact us immediately by e-mail. We will supply you with a replacement product ordered by you once the damaged product has been returned to us in accordance with the returns guidelines. If the product you have ordered is no longer available, please refer to the section refunds and credit notes.

Lost In Transit

All orders from us on our site will be delivered by independent courier companies. These couriers will use their best endeavours to supply you with the product you have ordered from us. On occasion however, goods are lost by the courier in transit to you. If after 7 days from your purchase date your order has not been delivered, you will need to contact us immediately by e-mail. We will immediately thereafter commence an "official consignment note trace" with the courier company concerned. If after 10 days from the date of your notification to us the goods cannot be located, we will supply you with a replacement product ordered by you. If the product you have ordered is no longer available, please refer to the section refunds and credit notes. 

Faulty Products

Our company takes pride in offering to our customers products that are quality products.

We will use our best endeavours to supply you with the product you have ordered from us in good condition.

On occasion however, goods that are sealed within cartons are faulty as a result of manufacturing defect from our supplier. If this occurs, you will need to contact us immediately by e-mail. We will supply you with a replacement product ordered by you once the faulty product has been returned to us in accordance with the returns guidelines. If the product you have ordered is no longer available, please refer to the section refunds and credit notes.

Returns

We respect your choice to shop with The Christmas Warehouse and if for any reason you are not happy with your purchase and wish to return it to us, you can do so within 14 days from purchase date, and as long as the product is in its original condition (including packaging) and returned to our warehouse (where applicable, within 7 days of an official return authorisation number being provided to you) the product will either be replaced or a credit note will be issued. We do not refund for change of mind purchases. The cost of freight for the returned product will be your responsibility.

We will only accept web sale returns that have been authorised by our company in advance and are accompanied by your original transaction receipt.

In the event of wrong product supplied by us to you, product damaged in transit to you, you must contact us within 48 hours of your delivery time that you wish to return a product you have purchased.

In the event of faulty products you must contact us within 14 days of your delivery date. It is essential that as soon as you become aware that a product is faulty that you cease using it immediately and contact us.

In the event of a product being damaged in transit to you, you must contact us within 48 hours of your delivery date that you wish to return a product you have purchased.

The authorisation required for a return will be an official Christmas Warehouse authorisation number. This number can be obtained by contacting us by e-mail. When you contact us, we will provide you with the official authorisation number and the appropriate delivery return address. The cost of the freight associated with the return will be your responsibility. We will not accept any returns to any delivery address other than the delivery address specified by us. This will be advised when you contact us. We will not accept any returns through our showroom shop or through any of our Megastores.

It is essential that all goods returned to us as an authorised return are in exactly the same brand new condition that they were sent to you. This includes the original packaging of the product.

Refunds & Credit Notes

In the event of a faulty product, you will need to return the product according to the guidelines set out above (see returns) before a refund or credit note can be issued.

In the event of incorrect goods supplied by us to you and goods are returned in accordance with the returns guidelines set out above and the correct goods that you ordered are no longer available, we will issue you with a credit note or refund.

In the event of products damaged in transit to you and goods are returned in accordance with the returns guidelines set out above and replacement goods that you ordered are no longer available, we will issue you with a credit note or refund.

In the event of products being lost in transit and we have received official confirmation from the courier company concerned that the goods have been lost in transit to you and replacement goods that you ordered are no longer available, we will issue you with a credit note or refund.

In the event of products not being available for supply to you after your order has been placed with us we will issue you with a credit note or refund for either part of the order or for the entire order (see above).

Sale of Display Stock

The Christmas Warehouse does not sell display products & samples during the Christmas trading season. There are many reasons for this ... some of them are listed below:

1. We have a huge range and thousands of customers. If a product is sold out and the sample is not on show, many customers will not have the opportunity to see it. Items that sell out are usually available again the next year, and many customers like to get in earlier to get a product they missed out on. It is our aim to show our whole range to all our customers.

2. Workplace health & safety policy dictates that we do not remove displays, use ladders, or create electrical hazards while stores are open and trading at their full capacity.

3. Our stores look wonderful ... to start removing items ruins the experience for so many of our customers.

End Of Season - most display products & samples will be sold

During the last few days of trading in any store, we do sell our display products ... OUR STAFF (BOTH IN-STORE AND AT HEAD OFFICE) DO NOT KNOW WHEN THIS WILL BE ... In fact, these decisions are often made at the last moment.

We DO NOT take names or hold this stock for customers.

Many customers often want to purchase the same item, and in the confusion this causes more problems ... We therefore have a “first-in best-dressed” policy.

We are very aware that many customers will be disappointed, and we deeply regret this. Please remember that, if an item has sold out this year ... we will stock plenty more the following year!

Please check our website regularly for specific store details including the actual dates when display stock will be sold.

Retail Quantity Limits

The Christmas Warehouse reserves the right, in our absolute discretion, to limit sales to retail quantities.

If we deem that the volume of products included in your transaction is not a reasonable retail quantity, we reserve the right to cancel your order. If such a case were to occur, we would process a credit to your nominated credit card and contact you to discuss the matter further.

International Customers

International orders

Christmas Warehouse welcomes all international orders. We can deliver worldwide to most destinations - anywhere where Australia Post delivers.

It's easy to order and pay for international orders through our normal website online shopping.

If you are placing an order for shipping to an international destination outside Australia, please note the following:

  • All prices are in Australian Dollars.
  • The majority of our products can be shipped internationally, but not all due to Australia Post size restrictions - please refer to the product detail page "shipping" section.
  • Normal processing times apply (refer to the freight and handling page).
  • We take great care in packing overseas shipments.
  • Your international shipping cost depends on the weight of the package and its destination. This is automatically calculated for you in your shopping cart or can be viewed during checkout.
  • Your international order does not include the payment of any duties (customs tariffs), taxes and brokerage fees associated with the shipment - these costs are the sole responsibility of the customer.
  • All electrical products are supplied using a standard Australian 3 pin plug. High voltage electrical products are 230 Volts. Low voltage electrical products are 12 Volts.

Use Of Goods

It is essential that all products purchased from The Christmas Warehouse are only used in the manner that they are intended to be used.

It is very important that the products purchased from us are not modified in any way whatsoever from the condition they were supplied in. We accept no responsibility whatsoever if products are modified in any manner from the condition that they were supplied. If you are at any time unsure about a products intended use, it is essential that you contact us by e-mail immediately for advice in this regard.

On our site, you will note that many products have specified whether the product is suitable for indoor and/or outdoor use. It is essential that products that are not specified specifically for outdoor use are only used indoors. The reason for this is that they are not suitable for outdoor use by virtue of their composition or electrical components.

With power to outdoor products and installations, we advise taking precautions at your power source in case of adverse weather conditions and checking with your local qualified electrician about safety and power aspects prior to installation of the products.

Our electrical products are designed for use in accordance with Australian standards, with a standard Australian wall plug and are intended for use with a 240 Volt power supply. Many electrical products use a transformer to convert them to low voltage - where applicable, this is specified in the respective product description. If you wish to use any electrical product outside Australia, please make suitable enquiries with your local electrical retailer or technician about using the product in your country.

Please take extra care with heavy and large products, electrical installations and general child safety precautions as you normally would with items of a similar nature.

At all times we will try to ensure that the graphics on our website are as accurate and as close to the actual products as possible. Computer colours and the large range of computer monitors available make the matching process a lot more difficult so on our website it is important to note that visual dimensions of products are used for graphic purposes only. In all cases, it essential that you use the actual written dimensions of each product when this is applicable.

As a condition of purchase from The Christmas Warehouse we reserve the right to email, sms and mail to you our newsletters and information that we may consider may be of interest to you.

We respect your right not to receive this information and if you advise us that you do not wish to receive this information we will disable that functionality for your account.

All our emails, sms messages, newsletters and communications of a similar nature will have a clear link to unsubscribe.

Limitation Of Liability


In no event shall The Christmas Warehouse be liable for any indirect, special, incidental or consequential damages or loss including but not limited to loss of income, loss of use, loss of data, loss of business or profits howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise. To the extent permitted by law, The Christmas Warehouse does not accept any liability for any damage or injury caused by the use or misuse of products purchased from The Christmas Warehouse. To the extent that The Christmas Warehouse may be liable for a breach of a condition of The Trade Practices Act 1974 (other than a condition or warranty implied by section 69 of the Act), the maximum aggregate liability for any product supplied to you whether in contract, tort (including negligence) or otherwise shall in no circumstances exceed the amount payable by you to us in respect of the product(s) in question.

Force Majeure


The Christmas Warehouse shall not be liable for any delay in performing any of its obligations under these terms and conditions if such delay is caused by circumstances beyond the reasonable control of The Christmas Warehouse, and The Christmas Warehouse shall be entitled to a reasonable extension of time for the performance of such obligations.

Applicable Law
